These Terms & Conditions (“Terms”) govern your access to and use of BrainyPDF at brainypdf.app and all associated PDF tools (collectively, the “Service”). If you do not agree to these Terms, do not use the Service.

1. The Service

BrainyPDF provides free online PDF utilities that run in your web browser. The Service is offered for personal and professional document tasks such as merging, splitting, compressing, editing, signing, watermarking, and encrypting PDF files.

PDF processing occurs locally on your device. We do not receive your PDF file content for server-side processing. See our Privacy Policy for details on data handling.

2. Eligibility

You must be at least 13 years old to use the Service. If you are using BrainyPDF on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Acceptable use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Process documents you are not authorized to access, modify, or distribute
• Attempt to bypass PDF security or encryption without lawful authorization
• Reverse engineer, scrape, or overload the website in ways that impair availability for others
• Introduce malware or interfere with the operation of the Service
• Misrepresent BrainyPDF or suggest an unsupported affiliation with us

The Unlock PDF tool is intended only for documents you own or are explicitly authorized to decrypt. You are solely responsible for ensuring your use complies with applicable laws and contractual obligations.

4. No account required

BrainyPDF does not require registration to use the tools. We may introduce optional features in the future; any additional terms will be disclosed at that time.

5. Intellectual property

The BrainyPDF name, logo, website design, and original content are owned by BrainyPDF or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, or distribute our branding without prior written permission.

You retain all rights to PDF files and content you process using the Service. BrainyPDF does not claim ownership of your documents.

The Service incorporates open-source software components subject to their respective licenses. Nothing in these Terms limits your rights under those open-source licenses.

6. Free service and changes

BrainyPDF is currently provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also update tool features, supported browsers, or these Terms.

Material changes to these Terms will be reflected by updating the “Last updated” date on this page. Your continued use after changes constitutes acceptance.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or produce output suitable for every purpose. PDF processing results may vary depending on source file structure, browser capabilities, and selected settings.

BrainyPDF is a general-purpose document utility, not legal, financial, or compliance advice. Electronic signatures, redactions, and encryption features may not satisfy all regulatory or contractual requirements in every jurisdiction. Consult qualified professionals when handling regulated documents.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINYPDF AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100. BECAUSE THE SERVICE IS FREE, THIS LIMIT WILL TYPICALLY BE USD $100.

Some jurisdictions do not allow certain limitations of liability; in those cases, our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless BrainyPDF and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your documents, or your violation of these Terms or applicable law.

10. Third-party links and fonts

The Service may link to third-party websites or load resources such as web fonts from external providers. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

11. Governing law

These Terms are governed by the laws applicable in the jurisdiction where BrainyPDF operates, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the courts of that jurisdiction, unless mandatory consumer protection laws in your country require otherwise.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
